These Terms & Conditions (“Terms”) govern your access to and use of the RealPodRacer website, including any related pages, content, features, forms, and services (collectively, the “Site”).

The Site is owned and operated by RealPodRacer Limited Co. (“RealPodRacer,” “we,” “us,” or “our”).

By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. About RealPodRacer

RealPodRacer is an independent design and engineering project. It is developed through exploratory work by a small group of designers, engineers, and/or advisors contributing alongside other professional commitments.

The Site may describe experimental concepts, prototypes, tests, and development progress. The Project and Site are provided for informational and general-interest purposes.

2. Eligibility

You must be at least 13 years old to use the Site. If you are under 18, you represent that you have permission from a parent or legal guardian.

3. Safety Disclaimer and No Professional Advice

RealPodRacer involves experimental designs, hardware, and testing that may be inherently dangerous.

  • The Site is not an instruction manual, training program, engineering service, aviation service, or safety guidance.

  • Do not attempt to build, replicate, operate, or modify any vehicle or system based on information from the Site.

  • You are solely responsible for complying with all applicable laws, regulations, and safety practices.

  • Any reliance on the Site is at your own risk.

Nothing on the Site constitutes professional engineering, legal, medical, or aviation advice.

4. Intellectual Property and Ownership

The Site and all content on it (including text, images, video, graphics, logos, designs, CAD previews, renderings, test data summaries, documentation, and other materials) are owned by RealPodRacer Limited Co. or its licensors and are protected by applicable intellectual property laws.

The RealPodRacer name, concepts, designs, and associated intellectual property are protected under applicable intellectual property laws.

Except as expressly allowed in these Terms, you may not copy, reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, transmit, sell, or exploit any Site content without our prior written permission.

5. Limited Permission to Use the Site

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your personal, non-commercial viewing, provided you comply with these Terms.

This license does not allow you to:

  • Use the Site content to build or fabricate real-world systems

  • Scrape, harvest, or systematically download content

  • Use our trademarks, names, or branding without permission

  • Misrepresent affiliation or endorsement

We reserve all rights not expressly granted.

6. No Affiliation / Third-Party Trademarks

We are in no way affiliated with Star Wars, Disney, Lucasfilm, or any property pertaining to “podracer” or “pod racer.” Any references are for descriptive or nominative purposes only.

All third-party names, logos, and trademarks are the property of their respective owners, and nothing on this Site should be interpreted as endorsement, sponsorship, or affiliation unless explicitly states as such.

7. User Submissions, Messages, and Feedback

If you submit comments, feedback, suggestions, ideas, designs, files, or other materials (“Submissions”), you agree that:

  1. No confidentiality: Unless you have a separate written agreement signed by RealPodRacer Limited Co. (for example, an NDA), your Submissions are not confidential and may be used by us.

  2. Permission to use: You grant RealPodRacer a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display your Submissions in connection with the Project and the Site.

  3. You have rights: You represent that you own or have the necessary rights to provide the Submissions and that they do not violate anyone else’s rights.

We are not obligated to review, use, or compensate you for any Submissions.

8. Community Conduct and Prohibited Use

You agree not to:

  • Use the Site for unlawful, harmful, or abusive purposes

  • Encourage unsafe replication of experimental systems

  • Post or transmit defamatory, infringing, obscene, or harassing content

  • Attempt to gain unauthorized access to the Site or its systems

  • Interfere with the Site’s operation (including via bots, scraping, or denial-of-service activity)

  • Misrepresent your identity or affiliation

We may remove content or restrict access at any time in our discretion.

9. Third-Party Links and Services

The Site may include links to third-party websites or services. We do not control them and are not responsible for their content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.

10. Privacy

11. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, REALPODRACER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the Site will be uninterrupted, secure, error-free, or that any content is accurate, complete, or current.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, REALPODRACER LIMITED CO. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, ADVISORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE OR ANY CONTENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, REALPODRACER’S TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless RealPodRacer Limited Co. and its officers, directors, employees, contractors, advisors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to:

  • your use of the Site

  • your violation of these Terms

  • your Submissions

  • your violation of any law or third-party right

14. Suspension and Termination

We may suspend or terminate your access to the Site at any time for any reason, including suspected violation of these Terms, without notice. Sections that should survive termination (including IP, disclaimers, limitation of liability, indemnification, and dispute terms) will survive.

15. Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date will change. Your continued use of the Site after changes means you accept the updated Terms.

16. Governing Law and Dispute Location

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles.

Exclusive forum: Any dispute, claim, or action arising out of or relating to these Terms or the Site must be brought exclusively in the state or federal courts located in Georgia, and you consent to personal jurisdiction and venue in those courts.

18. Entire Agreement

These Terms are the entire agreement between you and RealPodRacer regarding the Site and supersede any prior communications about the Site. If any provision is found unenforceable, the remainder remains in effect.
